1. Acceptance

“User Content” includes images, scripts, prompts, and other materials you submit, and outputs you generate. You represent and warrant that you have all rights necessary to submit User Content and to generate outputs, including rights of publicity and privacy for any depicted person.

As between you and Petri Wai, LLC, you retain your rights in User Content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display User Content solely to operate, maintain, and improve the Service, and to provide the outputs you request.

4. Prohibited Uses

• Violating any law or infringing intellectual property or privacy rights.
• Generating or distributing content that is illegal, defamatory, or non-consensual.
• Attempting to bypass safety, usage limits, billing, or access controls.
• Reverse engineering, scraping, or abusing the Service or underlying providers.

5. Plans, Billing, and Usage

The Service may be offered via paid subscriptions and usage-based entitlements (e.g., “seconds”). Prices, entitlements, and included features may change. Unless otherwise stated, subscriptions renew automatically until cancelled.

Payments are processed by third parties (e.g., Stripe). We do not store your full payment card details. Taxes may apply.

6. Availability; Third-Party Services

The Service relies on third-party infrastructure and AI model providers. We do not guarantee availability, uptime, or that outputs will be error-free or meet your expectations. Outputs are generated automatically and may be unpredictable.

7. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETRI WAI, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETRI WAI, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnity

You agree to indemnify and hold harmless Petri Wai, LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or your User Content.

10. Termination

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms or if needed to protect the Service. You may stop using the Service at any time; cancellation terms for subscriptions are handled through your billing portal.

11. Disputes; Governing Law

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Illinois, and you consent to jurisdiction and venue there.

12. Changes

We may update these Terms from time to time. The “Effective date” above will reflect the latest version. Continued use of the Service after changes constitutes acceptance.
